TERMS & CONDITIONS OF SALE, WARRANTY & REFERRAL PROGRAM

1. APPLICATION OF TERMS

These Terms apply to all purchases, trade accounts, referrals, advice, and supply of goods by All Sunshine Plumbing Pty Ltd (“ASP”, “we”, “us”).
By placing an order, the Customer agrees to these Terms.
Nothing in these Terms excludes, restricts or modifies rights under the Australian Consumer Law (“ACL”).
All information is provided by you at your option. You may choose not to provide any information but this may restrict our ability to assist you.

2. WATERMARK & PRODUCT COMPLIANCE

Where required by law, products supplied by ASP carry Australian WaterMark certification.
WaterMark certification confirms compliance with plumbing standards only. It does not guarantee that water treated by the system will be potable or free from all contaminants.
All filtration media and systems are supplied with the following condition:
This filtration media is not suitable for use with water that is microbiologically unsafe or of unknown quality without adequate disinfection and testing. Customers must ensure their water source meets applicable safety standards.
ASP does not warrant that any system will render water potable unless expressly stated in writing following appropriate testing.

3. SYSTEM RECOMMENDATIONS & WRITTEN ADVICE

Where ASP provides written advice or product recommendations:
  • Advice is based solely on information supplied by the Customer.
  • ASP does not independently verify site conditions unless separately contracted.
  • Final suitability remains the Customer’s responsibility.
No representation is made that a system is appropriate for a particular purpose unless confirmed in writing as a formal design certification.

4. WARRANTIES

4.1 Whole Home Systems (POE)
3-Year Structural Warranty

Covers:

  • Pressure vessels
  • Stainless steel housings
  • Structural frames
Excludes:
  • Cartridges and consumables
  • O-rings and fittings
  • Incorrect installation
  • Excessive pressure
  • Freezing
  • Chemical damage
  • UV degradation (unless rated)
  • External impact or misuse
4.2 UV Systems
3-Year Warranty on Electrical Components
Covers:
  • Ballasts
  • Electrical assemblies
  • UV chamber integrity
UV lamps are consumables and covered only for manufacturer defect upon arrival.
Warranty void if:
  • Installed without surge protection
  • Operated without water flow
  • Installed without required pre-filtration
  • Exposed to electrical surge or power instability
4.3 POU Systems
3-Year Warranty
Covers structural housing and manifolds.
Excludes consumables, installation faults, and misuse.
4.4 Consumables & Cartridges
Filter lifespan varies depending on:
  • Water chemistry
  • Sediment load
  • Usage volume
  • Flow rate
  • Maintenance
No guaranteed lifespan is provided unless stated in writing.

5. INSTALLATION REQUIREMENTS

Whole home and UV systems must be installed by:
  • A licensed plumber
  • A licensed electrician (where required)
Installation must comply with AS/NZS plumbing standards.
Failure to provide proof of licensed installation may void warranty.
ASP is not liable for:
  • Water damage
  • Flooding
  • Property damage
  • Insurance excess
  • Electrical damage
  • Loss of business or income

6. COMMERCIAL & HIGH-DEMAND APPLICATIONS

Products used in:
  • Commercial kitchens
  • Caravan parks
  • Mining operations
  • Industrial facilities
  • Multi-residential sites
Must be sized appropriately.
Incorrect sizing voids warranty.

7. RETURNS

Change-of-mind returns:
  • Within 14 days
  • Unused
  • In original packaging
  • Subject to 20% restocking fee
  • Customer pays return freight
No returns on:
  • Installed systems
  • Used cartridges
  • Custom systems
  • Special orders

8. PAYMENT TERMS

Payments are processed through Stripe and Worldline.
ASP does not store credit card details.
Chargebacks or payment disputes may result in:
  • Account suspension
  • Debt recovery action

9. LIMITATION OF LIABILITY

Where ASP provides written advice or product recommendations:

  • Liability is limited to the purchase price of the Product.
  • ASP excludes liability for indirect or consequential loss.
  • ASP excludes liability for:
    • Loss of water supply
    • Loss of business
    • Loss of income
    • Property damage beyond product replacement

10. VARIATION OF TERMS

ASP reserves the right to vary these Terms in exceptional circumstances including:
  • Force majeure events
  • Supplier changes
  • Regulatory changes
  • Legal requirements
  • Material market conditions
Where practical, Customers will be notified in advance.
Continued purchase constitutes acceptance of updated Terms.

11. INDEMNITY

The Customer indemnifies ASP against claims arising from:
  • Incorrect installation
  • Modification
  • Misuse
  • Failure to test water
  • Third-party claims arising from system performance

12. INTELLECTUAL PROPERTY

All:
  • System designs
  • TradeHub resources
  • Manuals
  • Website content
  • Marketing materials
Remain property of All Sunshine Plumbing Pty Ltd.
Reproduction or unauthorised use is prohibited.

13. FORCE MAJEURE

ASP is not liable for delay due to:
  • Supply chain disruption
  • Freight delays
  • Government action
  • Natural disasters
  • Industrial disputes

14. GOVERNING LAW

These Terms are governed by the laws of Queensland.
Disputes shall be resolved in Queensland courts.
